01 · Data controller
The controller responsible for your data is 46PRODU, Unipessoal Lda. (NIF/NIPC 516 284 391), with its registered office at Rua da Zona Industrial, 46, 3880-102 Ovar, Portugal, represented by its managing partner, Francisco Cortez. You can write to us at info@46produ.com with any question about this policy. Company registration details: Ovar Commercial Registry Office (Conservatória do Registo Comercial de Ovar), registration no. 516 284 391.
02 · What data we process
We only process the data you give us voluntarily when you fill in the contact form: your name, your email, what you need help with and, if you give them, your brand’s website or store, where you want to sell, how much you plan to invest and whether you want to sign a non-disclosure agreement. Sent along with them, without you having to type them, are the page you’re writing from, the campaign tag of the link you arrived through (if it has one; for example, one of our messages), the language of the site and the price list we showed you for your region.
Besides sending us your request by email, the server keeps a short copy (name, email, page, language, pricing and what you need help with) in an internal log, so that none are lost if the email fails. To stop automated submissions, it also keeps a fingerprint of your IP address (not the address itself) for about 10 minutes, after which it is discarded.
If you choose to message us on WhatsApp (the button only opens the app with a pre-written message; the website loads nothing from WhatsApp), we process your number and what you write only to reply to you and arrange the call, on the same legal basis and for the same periods. The service is provided by Meta Platforms Ireland Ltd., which processes that data as a controller under its own privacy policy.
We do not collect browsing data for advertising purposes and we do not use tracking cookies (more details in the cookie policy).
03 · What we use your data for
We use this data only to reply to your request, assess whether we can help you and prepare the 20-minute intro call. We do not use it for any other purpose or combine it with other sources.
04 · Legal basis
Under the General Data Protection Regulation (GDPR), the legal basis is your consent, which you give us when you submit the form, and taking steps at your request before entering into a contract (assessing and preparing a possible collaboration before anything is signed).
05 · How long we keep your data
We keep your data for as long as we need to handle your request and, if no business relationship follows, for no longer than 12 months. If you become a client, we keep your data for as long as the relationship lasts and for as long as the law requires.
06 · Who we share your data with
We do not sell or share your data with third parties. The only ones with access to it are the providers we need to run the website and reply to you: our web hosting and email provider (Hostinger International Ltd.) and the service the website runs through to protect it and speed it up (Cloudflare, Inc.), which also tells us the approximate country of each visit so we can show prices for your region, without us storing your IP address. They act as data processors, following our instructions.
08 · International transfers
Cloudflare, Inc. is based in the United States: that transfer relies on the EU-US Data Privacy Framework, which it has joined, and on the European Commission’s standard contractual clauses. If we use another provider outside the European Economic Area, it will only be with appropriate safeguards and we will say so here.
09 · Your rights
At any time you can ask us to access your data, correct it if it is wrong, erase it, object to its processing, restrict it, give it to you in a portable format or withdraw your consent, without affecting processing carried out before.
To exercise any of these rights, write to us at info@46produ.com. We will reply within 1–2 business days, and always within the one month set by the GDPR.
10 · Complaints to the supervisory authority
If you believe we have not handled your data properly, you can lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the supervisory authority in Portugal, without this affecting any other action you may wish to take.
11 · Changes to this policy
We may update this policy to reflect changes in the law or in how we handle your data. We will always publish the current version on this page, with the date of the last update.
